Terms & Conditions – Benson & Rowe Charleston

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

• Cooling-off period: the period during which the consumer may exercise the right of withdrawal.

• Consumer: a natural person not acting for purposes relating to trade, business, craft, or profession, who enters into a distance contract with the merchant.

• Day: calendar day.

• Durable data carrier: any tool that enables the consumer or the merchant to store information addressed personally to them in a way that allows future consultation and unaltered reproduction.

• Right of withdrawal: the consumer’s option to dissolve the distance contract within the cooling-off period.

• Merchant: Benson & Rowe Charleston 

• Distance contract: a contract concluded within the framework of a system organized by the merchant for distance sales of products, where exclusive use is made of means of distance communication.

Article 3 – Applicability

1. These Terms & Conditions apply to every offer by Benson & Rowe Charleston and to every distance contract and order concluded between the merchant and the consumer.

2. Before a distance contract is concluded, the text of these Terms & Conditions will be made available to the consumer electronically.

3. If one or more provisions are at any time wholly or partially void, the remainder of the agreement remains in force. The relevant provision will be replaced by a provision that reflects the original intent as closely as possible.

Article 4 – The Offer

1. If an offer has a limited validity or is subject to conditions, this will be expressly stated.

2. The offer contains a complete and accurate description of the products. Images are intended to be a faithful representation; however, obvious errors or mistakes in the offer (such as obvious pricing errors) do not bind Benson & Rowe Charleston.

3. All prices and information are subject to printing and typographical errors.

Article 5 – The Agreement

1. The agreement is concluded at the moment the consumer accepts the offer and meets the specified conditions.

2. If the consumer accepts the offer electronically, the merchant will promptly confirm receipt of acceptance via email.

3. Benson & Rowe Charleston takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment for payments.

Article 6 – Right of Withdrawal

1. When purchasing products, the consumer has the right to dissolve the agreement without giving reasons within 30 days. This period begins on the day after the consumer receives the product.

2. During the cooling-off period, the consumer shall handle the product and packaging with care. The product should only be unpacked or used to the extent necessary to determine its nature and characteristics.

3. To exercise this right, the consumer must notify the merchant within 30 days via written notice or email.

Article 7 – Costs in Case of Withdrawal

1. If the consumer exercises the right of withdrawal, the costs of returning the products are borne by the consumer.

2. The merchant will refund the amount paid as soon as possible, and no later than 14 business days after withdrawal, provided the product has been received back or conclusive proof of return has been provided.

Article 8 – Price and Import Duties

1. Prices of products will not be increased during the validity period stated in the offer, except for changes resulting from tax regulations.

2. Important: Depending on the destination, no sales tax may be charged at checkout because products may be shipped internationally. In such cases, import VAT, customs duties, and clearance fees may be collected by the carrier or customs upon entry into the destination country. These costs are the sole responsibility of the recipient/consumer.

Article 9 – Conformity and Warranty

1. The merchant warrants that the products conform to the contract and the specifications stated in the offer.

2. Any defective or incorrectly delivered products must be reported to the merchant in writing within 14 days after delivery. Products must be returned in their original packaging and in new condition.

Article 10 – Delivery and Performance

1. Benson & Rowe Charleston will take the greatest possible care when receiving and executing orders.

2. The place of delivery is the address provided by the consumer to the company.

3. Accepted orders will be executed with due speed, but no later than 30 days, unless a longer delivery period has been agreed upon. If delivery is delayed, the consumer will be notified accordingly.

Article 11 – Payment

1. Unless otherwise agreed, amounts owed by the consumer are due at the time of purchase/checkout.

2. The consumer is obliged to report any inaccuracies in payment details provided to the merchant immediately.

Article 12 – Complaints Procedure

1. Complaints about the performance of the agreement must be submitted to the merchant within 7 days after the consumer discovers the defect, providing a complete and clear description.

2. Complaints will receive a response within 14 days of receipt. If a complaint requires more time, the merchant will provide an acknowledgment and an indication of when a detailed response can be expected.

Article 13 – Disputes and Governing Law

Agreements between the merchant and the consumer to which these Terms & Conditions apply are governed by the laws of the State of South Carolina, USA. Venue and jurisdiction lie with the competent courts in South Carolina, unless mandatory law provides otherwise.
